CALIFORNIA SUPPLEMENTAL SETTLEMENT

IMPORTANT NOTICE

JUDGE HAMILTON ESTABLISHES OCTOBER 29, 2007
AS THE FINAL DEADLINE FOR THE FILING OF BOTH
CURRENT LANDOWNER BENEFIT CLAIMS
AND
PRIOR LANDOWNER BENEFIT CLAIMS.

On May 10, 2007, upon joint motion of Class Counsel and counsel for AT&T, Judge David F. Hamilton entered an order approving the Certain California "Telecommunication Cable"/Railroad Corridor Class Settlement Court Notice which establishes October 29, 2007 as the deadline for the filing claims for Current Landowner Benefits and Prior Landowner Benefits. Claim Forms must be postmarked by October 29, 2007, in order to be deemed to be within this deadline.

"TELECOMMUNICATION CABLE"
RAILROAD CORRIDOR CLASS SETTLEMENT

On April 6, 2005, in Spanish Springs, L.L.C. (f/k/a La Bahia Court, L.L.C.) v. AT&T Corp. (No. 1:03-cv-7012-DFH-TAB), United States District Judge David F. Hamilton (the "Court") conditionally approved a California "telecommunication cable"/railroad corridor settlement class, consisting, generally speaking, of the current (and certain past) owners of land underlying or adjacent to five (5) railroad corridors in California. On November 4, 2005, the Court entered a Final Order and Judgment finally approving the California Settlement.

After the Court entered its Final Order and Judgment, the parties determined that Class Member claims involving one (1) additional railroad corridor in California should also be settled, and agreed that the California Settlement Agreement must be supplemented to add this additional railroad corridor, that the parties must seek preliminary approval of this supplemental settlement, that supplemental notice would need to be sent to Class Members owning land adjoining or underlying the additional railroad corridor, and that the Court must finally approve this proposed supplemental settlement agreement.

On May 9, 2007, the parties filed the California Supplemental "Telecommunication Cable"/Railroad Corridor Class Settlement ("Supplemental Settlement Agreement"), and on May 10, 2007, the Court conditionally approved this Supplemental Settlement Agreement consisting, generally speaking of the current (and certain past) owners of land underlying or adjacent to one railroad corridor in California. The corridor is or was used to provide railway service between Reno to Sacramento.

The Court has preliminarily approved the settlement as fair, adequate, and reasonable for the Settlement Class, but the Court will conduct a hearing to make a final determination whether the Supplemental Settlement is fair, adequate, and reasonable and should be finally approved.

The settlement terms and the options a potential class member and claimant has are explained in the Supplemental Court Notice.

Fairness Hearing:
If objections or requests to appear and be heard have been received from any Class Member by August 13, 2007, the Court will hold the fairness hearing at 11:00 a.m. on Friday, September 21, 2007 at the following location:

If NO objections or requests to appear and be heard have been received from any Class Members by August 13, 2007, the Court will instead hold the fairness hearing at 2:00 p.m. on Thursday, October 18, 2007 at the following location:
