NEW JERSEY * * * * * * * IMPORTANT NOTICE JUDGE WELLERSON ESTABLISHES MAY 31, 2007 On October 23, 2006, upon joint motion of Class Counsel and counsel for AT&T, Judge Craig L. Wellerson entered an order approving the Certain New Jersey "Telecommunication Cable"/Railroad Corridor Class Settlement Court Notice which establishes May 31, 2007 as the deadline for the filing of claims for Current Landowner Benefits and Prior Landowner Benefits. Claim Forms must be postmarked by May 31, 2007, in order to be deemed to be within this deadline. CERTAIN NEW JERSEY On October 23, 2006, in Tammaro, et al v. AT&T Corp. et al (Docket No. BUR-L-002074-06), Superior Court of New Jersey Law Division: Burlington County Judge Craig L. Wellerson (the "Court") conditionally approved a New Jersey "telecommunication cable"/railroad corridor settlement class, consisting, generally speaking, of the current (and certain past) owners of land underlying or adjacent to twenty-two (22) railroad corridors in New Jersey. These corridors are or were used to provide railway service along: Camden to Finksburg (Camden to Wilmington Section), Cedar Knolls to Rochelle Park, Cortlandt to Rochelle Park, Freehold Branch (Jamesburg to Freehold), Freehold Branch to Newark Junction, Freehold to Manahawkin, Hamilton Square to Philadelphia Diversity (AMTRAK), Hamilton Square to Philadelphia Diversity (Conrail), New Brunswick Branch, New Brunswick to Cherryville (Conrail), New Brunswick to Cherryville (Black River & Western Corporation), New Brunswick to Freehold, Newark to Hamilton Square to Camden (Conrail), Newark to Hamilton Square to Camden (New Jersey Transit Corporation), NY 7 to Newark Junction (Conrail), NY 7 to Newark Junction (Rochelle Park Branch), NY7 to Newark Junction (New York, Susquehanna and Western Railway (Delaware Otsego)), Philadelphia to New York, Rochelle Park to Newark (Conrail), Rochelle Park to Newark (New Jersey Transit Corporation), and Rochelle Park to Newark (New York, Susquehanna and Western Railway (Delaware Otsego)). The Court has preliminarily approved the settlement as fair, adequate, and reasonable for the Settlement Class, but the Court will conduct a hearing to make a final determination whether the Settlement is fair, adequate, and reasonable and should be finally approved.
