IMPORTANT NOTICE

JUSTICE MOSKOWITZ ESTABLISHES JUNE 30, 2007
AS THE FINAL DEADLINE FOR THE FILING OF BOTH
CURRENT LANDOWNER BENEFIT CLAIMS
AND
PRIOR LANDOWNER BENEFIT CLAIMS.

On October 25, 2006, upon joint motion of Class Counsel and counsel for AT&T, Justice Karla Moskowitz entered an order approving the Certain New York "Telecommunication Cable"/Railroad Corridor Class Settlement Court Notice which establishes June 30, 2007 as the deadline for the filing claims for Current Landowner Benefits and Prior Landowner Benefits. Claim Forms must be postmarked by June 30, 2007, in order to be deemed to be within this deadline.

RAILROAD CORRIDOR CLASS SETTLEMENT

On October 25, 2006, in Bordwell, et al v. AT&T Corp. et al (Index No. 06:602551), Supreme Court of the State of New York, New York County, Superior Court of New York, Justice Karla Moskowitz (the "Court") conditionally approved a New York "telecommunication cable"/railroad corridor settlement class, consisting, generally speaking, of the current (and certain past) owners of land underlying or adjacent to seventeen (17) railroad corridors in New York. These corridors are or were used to provide railway service along: Albany to Poughkeepsie, Albany to Utica (Conrail), Albany to Utica (Canadian Pacific Railway / Delaware and Hudson Railway Company, Inc.), Binghamton to Roaring Creek (Conrail) , Binghamton to Roaring Creek (Canadian Pacific Railway / Delaware and Hudson Railway Company, Inc.), Binghamton to Syracuse, Buffalo to Erie, Buffalo to Niagara Falls, Keeseville to Albany, Keeseville USA to Canada, Philadelphia to New York, Poughkeepsie to Albany, Rochester to Buffalo (Conrail), Rochester to Buffalo (Rochester and Southern Railroad, Inc.), Syracuse to Binghamton, Syracuse to Rochester, and Utica to Syracuse.

The Court has preliminarily approved the settlement as fair, adequate, and reasonable for the Settlement Class, but the Court will conduct a hearing to make a final determination whether the Settlement is fair, adequate, and reasonable and should be finally approved.
