OKLAHOMA * * * * * * * IMPORTANT NOTICE JUDGE HAMILTON ESTABLISHES APRIL 18, 2007 On On April 6, 2006, upon joint motion of Class Counsel and counsel for AT&T, Judge David F. Hamilton entered an order approving the Certain Oklahoma "Telecommunication Cable"/Railroad Corridor Class Settlement Court Notice which establishes April 18, 2007 as the deadline for the filing claims for Current Landowner Benefits and Prior Landowner Benefits. Claim Forms must be postmarked by April 18, 2007, in order to be deemed to be within this deadline. CERTAIN OKLAHOMA On April 6, 2006, in Wallace, et al v. AT&T Corp. et al (No. 1:03-cv-7009-DFH-TAB), United States District Judge David F. Hamilton (the "Court") conditionally approved a Oklahoma "telecommunication cable"/railroad corridor settlement class, consisting, generally speaking, of the current (and certain past) owners of land underlying or adjacent to six (6) railroad corridors in Oklahoma. These corridors are or were used to provide railway service along Vinita Jct. to Tulsa (BNSF Railway Company), Holdenville to Dallas (Hughes City), Tulsa to Oklahoma City, Oklahoma City to Tucumcari, Ft. Smith to Tulsa, and Vinita Jct. to Tulsa (Tulsa-Sapulpa Union Railway Co.), and Wichita to Oklahoma City. The Court has preliminarily approved the settlement as fair, adequate, and reasonable for the Settlement Class, but the Court will conduct a hearing to make a final determination whether the Settlement is fair, adequate, and reasonable and should be finally approved. This home page provides some basic settlement information and copies of important documents for persons who know they are, or think they might be, members of this Settlement Class. The settlement terms and the options a potential class member and claimant has are explained in the Court Notice. Please Note the Following Important Dates: Deadline(s) to Comment, Object, or Opt Out: January 4, 2007 - For all class members except those who own land underlying or adjacent to the Wichita to Oklahoma City railroad corridor (Because the parties determined that a supplemental notice must be sent to current (and certain past) owners of land underlying or adjacent to the Tulsa to Oklahoma City railroad corridor in Oklahoma County, Oklahoma, we have extended the deadline for all class members to comment, object, or opt out from December 7, 2006 to January 4, 2007). January 15, 2007 – For all class members who own land underlying or adjacent to the Wichita to Oklahoma City railroad corridor. Fairness Hearing: United States Courthouse If NO objections or requests to appear and be heard have been received from any Class Members by January 4, 2007 (or January 15, 2007 for class members along the Wichita to Oklahoma City railroad corridor), the Court will instead hold the fairness hearing at 1:00 p.m. on February 1, 2007 at the following location: Courtroom of Judge David F. Hamilton Claims Deadline: April 18, 2007.
